Artist: Ever_CWClient: Y/NThis contract is automatically agreed to once a notion form is submitted.1. Scope of Work
The Artist agrees to create a custom digital artwork (the “Commission”) based on the Client’s provided character, concept, or prompt. The final piece will be delivered in a digital format (e.g., PNG, JPEG, or PDF) unless otherwise agreed.2. Payment
The Client agrees to pay the total amount agreed upon for the Commission. Payment confirms the Client’s agreement to the terms of this contract and grants the license described below.3. Licensing & Usage Rights
By paying for this drawing, the Client is purchasing a personal-use license to the commissioned artwork. This license includes the following rights:The Client may share, post, and display the artwork online or in personal spaces.The Client may use it as reference for their own characters or creative projects, as they own the character/prompt, but not the artwork itself.However, the Client may not:Sell, redistribute, or otherwise profit directly from this specific artwork.Create or sell merchandise (e.g., prints, apparel, stickers) using this artwork.Use this artwork in any generative AI, image AI, or machine learning datasets, including but not limited to ChatGPT, Gemini, Midjourney, DALL-E, Grok, or similar systems.Claim authorship of the artwork.All rights not expressly granted remain with the Artist.4. Copyright
The Artist retains full copyright and moral rights to the artwork. The Client’s purchase grants usage rights only as described above. If the Client wishes to use the artwork for commercial purposes, a separate written agreement and licensing fee will be required.5. Revisions and Delivery
Unless otherwise agreed, the Artist will provide an (AMOUNT OF REVISIONS YOU PERMIT) rounds of minor revisions before charging for more. The final artwork will be delivered by preferred method, (e.g., email, Google Drive, etc.) within a week of payment or sketch approval.6. Refunds and Cancellations
Once the final artwork has been approved or delivered, no refunds will be issued. If the Artist is unable to complete the commission for personal or unforeseen reasons, a partial or full refund may be provided at the Artist’s discretion.7. Agreement
By submitting payment, the Client acknowledges that they have read, understood, and agreed to the terms of this contract.
